PERSONAL DATA PROCESSING INFORMATION

Your personal data is processed in accordance with Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the „GDPR”).

The controller of your personal data is any of the following companies operating within our capital group:
a) „Dom Development Kraków” Sp. z o.o. with its registered office in Crakow, Wadowicka 3A, 30-347 Kraków
b) „Dom Development Kredyty” Sp. z o.o. with its registered office in Warsaw, Pl. Piłsudskiego 3, 00-078 Warszawa,
Each of the above companies shall hereinafter also be referred to as a "Controller", and all of them collectively as the "Controllers".
The Controllers have appointed a Data Protection Officer, whom you may contact in respect of any matters relating to the protection of your personal data:
a) by e-mail to: [email protected] ;
b) by letter to: „Dom Development Kraków” Sp. z o.o. marked with the reference „PDPO”.
In particular, you may contact the Controllers in the above manner in order to exercise your rights referred to in items 8 and 9 and/or to withdraw your consent, as referred to in item 10.
Your personal data will be processed for the purposes of:
a) direct marketing of products and services on the basis of your consent, if such consent has been given by you (legal basis: Article 6(1)(a) of the GDPR), or
b) taking action on your request before the conclusion of the contract, where such request has been expressed by you (legal basis: Article 6(1)(b) GDPR), or
c) holding a meeting with you with regard to the services and products delivered by the Controller, which is necessary for the pursuit of the Controller's legitimate interests (Article 6(1)(f) of the GDPR).
Categories of personal data processed (the information in this section is intended only for data subjects whose personal data has been obtained otherwise than from these data subjects):
a) contact details, e.g. name and surname, telephone number, email address, etc. or
b) shopping preferences, e.g. location, store size, etc.

Your personal data has been made available to the Controller by the entity whose services you have been using and which is listed in the header of this clause.
The information in this section is intended only for data subjects whose personal data has been obtained otherwise than from these data subjects, e.g. from a real estate agent or from another entity whose services those persons have been using.
Your personal data will be processed:
a) until the withdrawal of your consent to the processing of your personal data, if the processing is on the basis of your consent referred to in item 3(a); or
b) until the performance of the activities related to the conclusion of the contract referred to in item 3(b); or
c) with regard of the pursuit of the legitimate interests of the Controller referred to in item 3(c) - until the lodgement of an objection or until the date of the meeting.
The recipients of your personal data may include:
a) employees and contractors of the Controller,
b) entities that provide services to the Controller, in particular, IT, marketing and telecommunication services to which the Controller will have entrusted the processing of personal data,
c) real estate agents (if your consent has been obtained through them).
Your personal data will not be transferred to any third country, i.e. to any country based outside the European Economic Area.
You have the right to request access to your personal data, to rectify or delete your personal data, to request the restriction of processing of your personal data and to transfer your data.
If your personal data is processed on the basis of legitimate interests, you have the right to object to the processing for reasons associated with your particular situation. You also have the right to object to the processing of your personal data for direct marketing purposes.
To the extent to which you have given consent to the processing of your personal data, you have the right to withdraw that consent any time, without impacting on the legality of the processing of your personal data that has been done on the basis of your consent before it was withdrawn.
You have the right to file a complaint with the data protection authority (President of the Personal Data Protection Office).

4. Your personal data shall be processed until the statute of limitations for the claims referred to in point 3(b) has expired.
5. The recipients of your personal data may be:

employees and associates of the Controller,
entities providing services to the Controller, in particular IT services, telecommunication services, courier services, marketing services, insurance services, satisfaction surveys services, real estate management (administration) services, entities providing billing and accounting services and other entities servicing the investment, services in the scope of investment implementation and finishing of individual premises, services in the scope of repairs under the guarantee or warranty, to whom the Controller entrusts the processing of personal data.

6.   Your personal data may be transferred to third countries, i.e. countries outside the European Economic Area.
7.   You have the right to request access to your personal data, rectification, erasure, restriction of processing, as well as the right to data portability.
8.   You have the right to object to the processing on grounds relating to your particular situation.
9.   You have the right to lodge a complaint with the supervisory authority in charge of personal data protection (President of the Office for Personal Data Protection/ Prezes Urzędu Ochrony Danych Osobowych).
10.   The Controller shall not make decisions based solely on automated processing, including profiling, and which would produce legal effects on you or similarly significantly affect you.
11.   The provision of personal data is voluntary, but it is a condition for the performance of activities covered by the mandate. The consequence of failing to provide such data shall be the impossibility to carry out these activities. The information in this section is intended only for persons whose personal data are obtained directly from such persons.
12.   Your personal data have been made available to the Controller by your principal in connection with the performance of activities covered by the scope of the power of attorney granted.
The information in this section is intended only for persons whose personal data were obtained in a manner other than from such persons, i.e. e.g. from the principal.
13.   The scope of your personal data processed by the Controller includes data necessary for the performance of activities covered by the scope of the power of attorney.

Information on change of name

On 10 August 2022, the District Court for Kraków Śródmieście in Kraków, 11th Commercial Division of the National Court Register registered a change of the company (name) of Buma Development 12 Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków. Thus, the name of the company was changed from the current one:

"Buma Development 12 Spółka z ograniczoną odpowiedzialnością" with its registered office in Kraków address: 30-347 Kraków, ul. Wadowicka 3A, REGON: 387364647, NIP: 6793207264, KRS: 0000866174 to the following:

"Dom Development Kraków 12 Spółka z ograniczoną odpowiedzialnością" with its registered office in Kraków address: 30-347 Kraków, ul. Wadowicka 3A, REGON: 387364647, NIP: 6793207264, KRS: 0000866174.

We would like to inform you that this change covers only the name of the company. All other registration data, including numbers: NIP, KRS, REGON, registered office of the company and its legal form remain unchanged. Furthermore, we would like to point out that the change of the company (name) does not result in a change of the entity, which still remains a party to the already concluded agreements. Therefore, all documents signed so far by Buma Development 12 sp. z o.o. remain in force and do not need to be annexed or terminated.
