Information clause of Dom Development Kraków 12 Sp. z o.o. - Purchase of premises

Your personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "GDPR").
1.    The controller of your personal data is Dom Development Kraków 12 Sp. z o.o. with its registered office in Kraków (30-347) at ul. Wadowicka 3A (hereinafter referred to as "Controller").

3.    In particular, you may contact us as instructed above in order to exercise your rights as referred to in points 7 and 8 or to withdraw your consent as referred to in point 9.
3.    Your personal data may be processed for the following purposes:

•  to conclude a contract concerning products or services purchased from the Controller - in each case on the basis of your request for the preparation of such a contract (legal basis for so-called ordinary personal data - Article 6(1)(b) GDPR) or under your consent, if granted (legal basis for personal data concerning health, if its processing is necessary to take the aforementioned steps - Article 9(2)(a) GDPR), or
• to execute a contract concerning products or services purchased from the Controller - in each case if it is concluded - on the basis of the performance of the contract (legal basis for so-called ordinary personal data - Article 6(1)(b) GDPR) or under your consent, if given (legal basis for personal data concerning health, if its processing is necessary for the performance of the contract - Article 9(2)(a) GDPR), or
• to fulfil the Controller's legal obligations, in particular those imposed by the Act of 16 September 2011 on the protection of the rights of a purchaser of a dwelling or a detached house or the Act of 24 June 1994 on the ownership of premises (legal basis: Article 6(1)(c) GDPR), or
• to organize customer satisfaction surveys and to determine service and product quality, which is a legitimate interest of the Controller (legal basis: Article 6(1)(f) GDPR), or
• to establish, pursue or defence of possible claims which is a legitimate interest of the Controller (legal basis: Article 6(1)(f) GDPR), or
• to organize direct marketing of products and services which is a legitimate interest of the Controller (legal basis: Article 6(1)(f) GDPR),

4.    Your personal data shall be processed for the period necessary for the purposes of the processing indicated in point 3, i.e.:

• for contractual steps, for as long as is necessary to take such steps;
• for the performance of a contract, for the period necessary for the performance of the contract;
• for fulfilment of legal obligations incumbent on the Controller, for the period necessary for the Controller to fulfil those obligations;
• for organizing customer satisfaction surveys and determining service and product quality, for a period no longer than that specified in point 4(e);
• for establishment, assertion or defence of claims, for the period of limitation of such claims provided for by law;
• for direct marketing - until you raise an objection.

5.    The recipients of your personal data may be:

• employees and associates of the Controller,
• banks operating housing trust accounts,
• notaries,
• entities providing utility services,
• housing associations represented by their appointed bodies,
• entities providing services to the Controller, in particular IT services, telecommunication services, courier services, marketing services, insurance services, satisfaction surveys services, real estate management (administration) services, entities providing billing and accounting services and other entities servicing the investment, services in the scope of investment implementation and finishing of individual premises, services in the scope of repairs under the guarantee or warranty to whom the Controller entrusts the processing of personal data.

6.    Your personal data may be transferred to third countries, i.e. countries outside the European Economic Area.
7.    You have the right to request access to your personal data, rectification, erasure, restriction of processing, as well as the right to data portability.
8.    If the processing of your personal data is based on a legitimate interest, you have the right to object to the processing on grounds relating to your particular situation. You also have the right to object to the processing of your personal data for direct marketing purposes.
9.    To the extent that you have given your consent to the processing of your personal data, you have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.
10.   You have the right to lodge a complaint with the supervisory authority in charge of personal data protection (President of the Office for Personal Data Protection/ Prezes Urzędu Ochrony Danych Osobowych).
11.   Providing personal data is voluntary, but at the same time it is a condition for preparing and then concluding a reservation declaration (contract) or a preliminary sales contract, as well as contracts that may be prepared and concluded following this reservation declaration (contract) or preliminary sales contract, i.e. in particular the development contract, agreement on establishment of separate ownership of premises and sales contract and other possible contracts concerning products or services purchased from the Controller. The consequence of failing to provide such data shall be the inability to prepare and conclude the aforementioned contracts.
12.  The Controller shall not make decisions which are based solely on automated processing, including profiling and which would produce legal effects on you or similarly significantly affect you.

Information on change of name

The District Court for Kraków Śródmieście in Kraków, 11th  Commercial Division of the National Court Register registered a change of the company (name) of Buma Development 12 Spółka z ograniczoną odpowiedzialnością with its registered office in Kraków on 10 August 2022. Thus, the name of the company was changed from the current one:

"Buma Development 12 Spółka z ograniczoną odpowiedzialnością" with its registered office in Kraków address: 30-347 Kraków, ul. Wadowicka 3A, REGON: 387364647, NIP: 6793207264, KRS: 0000866174 to the following:

"Dom Development Kraków 12 Spółka z ograniczoną odpowiedzialnością" with its registered office in Kraków address: 30-347 Kraków, ul. Wadowicka 3A, REGON: 387364647, NIP: 6793207264, KRS: 0000866174.

We would like to inform you that this change covers only the name of the company. All other registration data, including numbers: NIP, KRS, REGON, registered office of the company and its legal form remain unchanged. Furthermore, we would like to point out that the change of the company (name) does not result in a change of the entity that still remains a party to the already concluded contracts. Therefore, all contracts signed so far by Buma Development 12 sp. z o.o. remain in force and remain in force and do not need to be annexed or terminated.
